James Barbato Is a low life rip-off!

Jeez this guy is a real scumbag! He stole 430.00 in reptiles.

He made an order of around $300.00 worth of viper geckos, the transaction went through fine and he received the animals. A week later he e-mailed me wanting more, yet he didn't have the money but would send it as soon as he got paid. I agreed because everything went through fine the first time. STUPID! Normally I would have done paper work but he was very anxious to get the animals and I had done business with him before and it was smooth.

He received the animals told me they arrived great and already produced three eggs for him! He asked how to incubate and told me the money would be her in about a week. A week went by and nothing. I have e-mailed him a few times and he still has not replied. Finally he closed his e-mail account...son of a must have a pretty crummy conscious.


The first transaction was fine, so I am not posting it. If any one wants it PM me.

If I need to post more just ask.

I was able to send him a message I don't know why I got a failure notice before. So I guess his e-mail account is actualy not closed. He just is not responding. I told him I would drop it if he would just respond

It would appear he didn't have to stall Luc at all or hope that Luc would just forget about it. According to the email above from Luc....the guy had all the time in the world to pay the debt off.

Just my opinion...but the title of this thread is completely and totally inappropriate after reading that email from Luc. Just cant see how the guy is a lowlife or rip-off artist for following the terms of the deal.

I think he is owed an apology.

Yes I gave him until he had the money. He told me to weeks ago that he would have the money out to me Thursday. I received nothing. I e-mailed him and e-mailed him. Finally I got a failure notice! I believed that he had ripped me off and that is why I started this thread with the aggressive title. Not for myself, but for anyone else that was planning to sell to him. After all I thought I had lost communication with him, so how was I supposed to even tell him about this thread?

Here is his e-mail stating that he could get the funds to me Thursday, remember after this message I received nothing for two weeks!

Are you blind as well as slow? Yes I think you do owe him an apology. I would not have wrote it the first time if it was not what I thought as appropriate.

You were in control. You made the deal. You extended him the credit. You said he could pay you whenever he had it. You made this arrangement with him.

If you had a time frame of when he had to pay you then you should have clearly defined that time frame to him when extending him the credit. That is not what you did, so you caused this on yourself.

Apologize to him or don't, I don't really care, its only what I think you owe him. But do yourself a huge favor and stop making idiotic deals with open ended payment arrangements and then crying about here how you've become a victim when you haven't been paid within 14 days.

If you told me to 'pay you whenever I had it', it would be when I produced and sold enough babies of the animals that you extended to me on credit. Nothing wrong with that considering you extended me that privilege. And if you busted my balls for it by starting a negative thread here on the BOI - calling me a lowlife or con-artist- you'd be waiting an awful long time for any compensation let alone communication.

And your email records suck. Full or partial headers accompanied with the emails are what I would deem acceptable forms of proof. Some of the ones you posted don't even include dates to form a time line of correspondence.

Get your act together and quit crying because you don't have a clue about how to go about doing proper business.

He's not one of the other members...he's "critical bill"! He's harsh, blunt, to the point, and sometimes a dick. The fact remains that he is most times pretty accurate in his assessments (except when he called me capt numbnuts....I can feel them just fine).

You gave this buyer animals with an open ended timeline regarding payment...you were BEGGING to be taken advantage of. You specifically told him "no rush" and "send the money when you can". Yeah, the guy's a jerk for deciding that "when you can" meant never, but when I read this thread, I was amazed at how irresponsible a seller you were...not for your treatment of a buyer, but for your lack of forethought in this transaction.

Sometimes you can tell someone time and again, "that's hot", but until they get burned, they just won't take your word for it. I'm sorry you had to learn this leasson the hard way, but you should have known better after reading what's posted here on a daily basis...especially after your DTS encounter.

I don't have anything personal against you. I've posted my opinion and you can shrug it off or let it nag at you. I'll post my opinion again. I feel the main problem in this transaction was how you arranged/worded things with your buyer. If you are suffering its because you screwed up.

Sorry my opinion isn't what you wanted to hear, but keep asking around for others and you'll be bound to find exactly what you wanted to hear.

Yes I did learn my lesson. I am warning you guys, although I am sure most of you are smarter than I and don't lend animals on credit.

No Mr. Kimmel, I admire your craziness its what is called for sometimes to take bad guys down, like Dan Scolaro. But I did not do anything necicarily wrong. I was just STUPID to lend on credit. I have learned my lesson. I am young in this hobby and have many more lessons to learn.

Because he had another group aside from what he purchased from you and he decided to sell that other group?

Looky here...I know you are trying to say that the geckos he has for sale are the same ones he purchased from you. But did he post a picture of the geckos for sale in that advertisement that you can clearly identify as being the ones you sold him?

Now I have a question for you....

Prior to extending this customer the credit that he requested, did you ever bother to inquire about him here on the BOI? I already know the answer so you don't really have to bother answering. I know you just figured because you had one good deal with him that it should be OK. But you bypassed some golden rules in business. This site is also an invaluable tool - and when you use it for exactly what it was designed for - you can save yourself a great deal of disappointment - Jusssssst like this. I guess what I'm saying is that.. if you aren't bright enough to make good business decisions for yourself..the BOI can really be a cool tool working on your side.

But whatever...keep on disappointing yourself - it makes it more fun for me pointing out your mistakes and watching you get angry.
